ACCEPTANCE OF TERMS

GetSlot owns and provides various Sites, services, and software that facilitate online scheduling of appointments (collectively, the “Services“) via www.getslot.io and/or its sub-domains, mobile sites, mobile applications (collectively the “Sites” or “GetSlot Sites”). In these Terms of Service, we refer to the applicable contracting entity, as specified in the ‘Contracting Entity and Applicable Law’ section, as “GetSlot,” “us,” or “we”.

“You,” “yourself,” and “Business” shall refer to any natural person or any legal entity and its authorized staff that subscribe or sign up for the Business Account or use the Services available at business.getslot.com. GetSlot and the Business may be individually referred to as a “Party” and collectively referred to as the “Parties”.

By creating the Account with GetSlot and accessing the Sites and the Services, you agree that you are authorized to accept the terms set forth below (the “Terms of Service“, or “Service Agreement” or “Agreement”) on behalf of yourself or the entity that you represent along with the Data Processing Addendum (DPA), any applicable SaaS Order Form, Privacy Notice, and laws and government regulations applicable to GetSlot’s business, during each Subscription Term. You represent and warrant that you have the right, authority, and capacity to enter into these Terms (on behalf of yourself or the entity that you represent). Any and all use of the Services is subject to these Terms of Service. If you do not agree with all of the provisions of these Terms, do not access and/or use the Platform. By continuing to use the Services, you agree to be bound by these Terms of Service.

IF YOU ARE A GETSLOT BUSINESS LOCATED IN THE EUROPEAN ECONOMIC AREA, SWITZERLAND, OR UNITED KINGDOM, THE DATA PROCESSING ADDENDUM ACCOMPANIES THESE TERMS AND SETS FORTH OTHER TERMS OF OUR AGREEMENT THAT APPLY SOLELY TO THE EXTENT ANY INFORMATION YOU PROVIDE TO GETSLOT INCLUDES PERSONAL DATA OF INDIVIDUALS LOCATED IN THE EUROPEAN ECONOMIC AREA, SWITZERLAND, AND THE UNITED KINGDOM.

You agree to be bound by and adhere to these Terms of Service, and confirm to us that you have the authority to enter into this Service Agreement on behalf of your company. Your usage of our services will be taken to mean that you have accepted the Terms of Service, and agreed to be bound by them.

Modifications and changes to this Service Agreement

GetSlot reserves the right, at its sole discretion, to change, modify, update, add, or remove portions of the Terms of Service at any time, with or without notice to you. Please check these Terms of Service, available on the GetSlot Sites and under the “My Membership” section of your GetSlot account or your registered email address, periodically for changes. Your continued use of the Services after the posting of any changes to the Terms of Service will signify your acceptance of those changes.

The parties acknowledge and agree that, by executing the Service Agreement, you enter into the Service Agreement on behalf of yourself and, as applicable, in the name and on behalf of your employees, representatives, consultants, contractors, or agents who are authorized to use the Services for your benefit (“Authorized Affiliates”), thereby establishing a separate Service Agreement between GetSlot and each such Authorized Affiliate subject to this provision of the Service Agreement. Each Authorized Affiliate agrees to be bound by the obligations under this Service Agreement and the GetSlot Privacy Policy (to the extent this policy is applicable to them). All access to and use of the Services and Content by Authorized Affiliates must comply with the terms and conditions of the Service Agreement, and any violation of the terms and conditions of the Service Agreement by an Authorized Affiliate shall be deemed a violation by Business.

These Terms of Service are also applicable to the staff members who gain access to your account. You must make sure they are aware of and understand these Terms of Service as well.

BY ACCEPTING THIS SERVICE AGREEMENT, EITHER BY (I) CLICKING A BOX INDICATING YOUR ACCEPTANCE; OR (II) BY EXECUTING AN ORDER FORM THAT REFERENCES THIS SERVICE AGREEMENT; OR (III) BY DIGITALLY OR MANUALLY SIGNING THIS SERVICE AGREEMENT, YOU AGREE TO THE TERMS OF THIS SERVICE AGREEMENT. IF YOU ARE ENTERING INTO THIS SERVICE AGREEMENT ON BEHALF OF A COMPANY OR OTHER LEGAL ENTITY, YOU REPRESENT THAT YOU HAVE THE AUTHORITY TO BIND SUCH ENTITY AND ITS AFFILIATES TO THESE TERMS AND CONDITIONS, IN WHICH CASE THE TERMS “BUSINESS” SHALL REFER TO SUCH ENTITY AND ITS AFFILIATES. IF YOU DO NOT HAVE SUCH AUTHORITY, OR IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, YOU MUST NOT ACCEPT THIS SERVICE AGREEMENT AND YOU MAY NOT USE THE SERVICE.

By signing this Service Agreement or checking an “agree” box, you are agreeing to abide by the full terms of the legal Service Agreement.

It is your responsibility to use the Services properly and effectively. By using the Services, you warrant that you will use the Services only for the purposes advertised on the GetSlot Sites, that you are a valid business desiring to use the Services to advertise your business and generate online appointments from End Users using the Services, and that any contact information you provide, such as email addresses and phone numbers, is valid and active contact information for you. Any breach of this section will result in termination of your account. We reserve the right to pursue any remedies available to us at law or in equity for any breach of this Section.
